Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and the operator of FundedTax ("FundedTax," "we," or "us") governing your access to and use of the FundedTax hosted service (the "Service"). FundedTax is hosted software-as-a-service; no software is sold, installed, or transferred to you. Please read Section 4 (Acceptance), Section 5 (Not tax advice), and Section 7 (Billing and Merchant of Record) carefully.

1. Service description

FundedTax is informational software for funded prop firm traders. It imports prop-firm payout statements via CSV, suggests draft prop-firm-specific income and expense categories that you review and confirm, performs automated self-employment and federal income tax calculations from the data you enter or import, and produces a year-end Schedule C summary worksheet in PDF and CSV formats for use with third-party tax preparation tools or with your licensed tax professional.

2. Who you are contracting with

FundedTax is operated by Muhammad Hassaan Javed, an individual sole proprietor located in Pakistan, doing business as FundedTax. References to "FundedTax," "we," "us," or "our" mean Muhammad Hassaan Javed d/b/a FundedTax, unless an executed order form expressly identifies another legal entity. FundedTax is not currently a corporation, limited liability company, partnership, accounting firm, law firm, CPA firm, enrolled-agent practice, or tax-return preparation firm. No officers, employees, or agents exist unless and until an entity is formed.

FundedTax currently operates as a sole proprietorship. A postal address for legal notices is available on request at the contact above. If FundedTax later forms an operating entity and assigns these Terms to it, the assignment will not reduce your non-waivable consumer rights.

3. Eligibility

You represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and will use the Service solely for your own US tax recordkeeping. The Service is intended for adults handling their own tax records; it is not intended for anyone under 18.

4. Acceptance of these Terms

You accept these Terms by checking the "I have read and agree to the Terms of Service and Privacy Policy" box presented at account creation or first sign-in, or by accessing the Service, whichever occurs first. We record the version of the Terms you accepted together with your account identifier and the time of acceptance.

5. Not tax advice

FundedTax is informational software. The Service does not constitute tax, legal, accounting, financial, or regulatory advice of any kind. The founder of FundedTax is not a Certified Public Accountant (CPA), Enrolled Agent (EA), attorney, or other licensed tax professional.

FundedTax does not determine your final tax treatment. The Service provides software-generated draft categorizations, estimates, reconciliation aids, and exportable record summaries based on information you enter or import. You must review, edit, verify, and approve all categories, amounts, assumptions, and exports before using or relying on them. FundedTax does not sign, file, submit, transmit, or prepare any tax return or claim for refund, and FundedTax is not responsible for deciding whether any income, expense, deduction, tax position, safe harbor, filing status, form, schedule, or return position applies to you. The Service is not a substitute for TurboTax, a CPA, an enrolled agent, an attorney, or another qualified tax professional. You are solely responsible for the accuracy of your tax return and for compliance with all applicable tax laws.

6. Automated calculations, not a preparer

FundedTax performs automated calculations from data you enter or import. It does not exercise professional judgment about your specific tax situation, does not prepare or sign returns, and is not a tax return preparer. Any categorization or estimate the Service produces is a draft starting point for your review, not a determination of your tax position.

7. Billing and Merchant of Record

Paid subscriptions to the Service are sold by a third-party Merchant of Record acting as authorized reseller and seller of record. The Merchant of Record, not FundedTax, is the party you purchase from. Your purchase, payment method, invoices, taxes and VAT/sales tax, subscription renewal, billing support, chargebacks, transaction-level refunds, and cancellation of recurring charges are governed by the Merchant of Record's buyer terms and checkout disclosures, accepted at checkout. We provide and support the Service; the Merchant of Record provides first-tier transactional support for payments, refunds, chargebacks, and subscription cancellation. Where these Terms conflict with the Merchant of Record's terms on payment, taxes, billing, renewal, cancellation of recurring charges, or transaction refunds, the Merchant of Record's terms control to the extent of the conflict for those matters.

The Merchant of Record for FundedTax is being finalized. Once confirmed, it will be named here with a link to its buyer terms, and the cancellation and renewal disclosures will reflect its checkout flow.

Subscriptions renew automatically until cancelled. After any trial or promotional period, your subscription renews at the price published at checkout plus applicable taxes unless cancelled before the renewal date. You manage and cancel your subscription through the Merchant of Record's flow as disclosed at checkout; cancelling stops future renewals and takes effect at the end of the current billing period. Fees already paid are non-refundable after the billing period begins, except where required by applicable law, handled under the Merchant of Record's buyer terms, or where a mandatory consumer withdrawal right (such as an EU, UK, or other statutory withdrawal right) applies. The Merchant of Record may issue refunds or process chargebacks as required by law, card-network rules, or its buyer terms.

8. Right to access the hosted Service

Subject to these Terms and payment of applicable fees through the Merchant of Record, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the hosted FundedTax Service during your subscription term for your own tax recordkeeping. No software is sold or transferred to you, and nothing is installed on your systems. We reserve all rights not expressly granted.

9. Acceptable use and restrictions

You will not, and will not permit any third party to:

  • Attempt to reverse engineer or derive the underlying structure of the Service, except to the extent that restriction is prohibited by applicable law.
  • Resell, sublicense, rent, lease, or otherwise commercially exploit access to the Service.
  • Use the Service to provide tax preparation, accounting, or legal services to any third party for compensation.
  • Use the Service in violation of applicable law, including U.S. federal and state tax laws and the rules of any prop firm whose data you import.

10. Customer Data

You own all data you submit to the Service, including imported prop-firm CSVs, transaction categorizations, and expense entries ("Customer Data"). You grant FundedTax a limited license to host, process, and display Customer Data solely to provide and support the Service. Our data handling is described in the Privacy Policy and, where we act as a processor, in the Data Processing Addendum. You are instructed not to enter Social Security Numbers, ITINs, EINs, or other taxpayer identification numbers into the Service; no field requests them and they are not written to exports.

11. Data Processing Addendum

To the extent FundedTax processes personal data on your behalf, the FundedTax Data Processing Addendum is incorporated into and forms part of these Terms. If there is a conflict between these Terms and the Data Processing Addendum regarding the processing of personal data, the Data Processing Addendum controls.

12. Third-party services

FundedTax relies on the subprocessors listed on our Subprocessors page. FundedTax is not affiliated with Apex Trader Funding, TopStep, FTMO, Tradeify, MyFundedFutures, Intuit (TurboTax), H&R Block, or any prop firm or tax-software vendor whose name appears in the Service or in marketing materials. FundedTax does not access IRS records or any taxing authority's systems.

13. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law. FundedTax does not warrant that calculations produced by the Service are accurate for your specific tax situation, that imports parse all CSV formats correctly, that any estimate avoids underpayment or penalties, or that the Service will meet the requirements of any taxing authority. Nothing in the Service constitutes tax, legal, or accounting advice.

14. Limitation of liability

To the maximum extent permitted by applicable law, FundedTax's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amounts you paid for the Service in the twelve months before the event giving rise to the claim. In no event will FundedTax be liable for any indirect, incidental, special, consequential, or punitive damages, including tax penalties, interest assessed by a taxing authority, lost profits, or amounts owed to a tax authority on returns you filed, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, willful misconduct, gross negligence where not waivable, death or personal injury caused by negligence, or any non-waivable statutory consumer or data-protection rights and remedies.

15. Indemnification

To the extent permitted by applicable law, and excluding consumers where local law prohibits the indemnity, you agree to defend, indemnify, and hold harmless FundedTax from third-party claims, damages, liabilities, costs, and expenses arising out of (a) your use of the Service in violation of these Terms or applicable law; (b) your infringement of a third party's rights; or (c) your Customer Data. We will give you prompt notice of the claim, allow you to control the defense (with counsel reasonably acceptable to us), and cooperate at your expense; you will not settle any claim in a way that admits liability for us or imposes a non-monetary obligation on us without our prior written consent.

16. Confidentiality

Each party may receive non-public information of the other that is marked or reasonably understood to be confidential ("Confidential Information"), including Customer Data. Each party will use the other's Confidential Information only to perform under these Terms and will protect it with at least reasonable care. This obligation does not apply to information that is or becomes public through no fault of the receiving party, was already known without a duty of confidentiality, or is required to be disclosed by law (with notice where lawful).

17. Term and termination

These Terms remain in effect for the duration of your active subscription. Either party may terminate as described in Section 7. FundedTax may suspend or terminate your access immediately for material breach of these Terms, including non-payment. Before deletion, and for a reasonable window after termination, you may export your Customer Data and download previously generated worksheets. Sections 2, 5, 6, 10, 13, 14, 15, 16, 19, and 20 survive termination; the license in Section 10 survives only as needed to complete deletion or return of Customer Data and the post-termination export window.

18. General (boilerplate)

  • Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will stay in full force.
  • Entire agreement. These Terms, together with the Privacy Policy, the Data Processing Addendum, and any order form, are the entire agreement between the parties regarding the Service and supersede prior agreements on that subject.
  • Assignment. You may not assign these Terms without our consent. We may assign these Terms to a successor entity in connection with a reorganization, incorporation, merger, or sale of the business.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
  • Notices. We may give notice by email to your registered address or by posting on the Service. You may give notice to legal@fundedtax.com.

19. Governing law and dispute resolution

These Terms are governed by the laws of the Islamic Republic of Pakistan, where the operator is currently based, without regard to its conflict-of-laws rules, and the courts located there have jurisdiction. This reflects the operator's current sole-proprietor posture and will be updated when an operating entity is formed. Nothing in these Terms limits any non-waivable rights or remedies available under the law of the jurisdiction where the customer is legally entitled to those protections.

20. Changes to these Terms

We may update these Terms from time to time. We will give at least 30 days' notice of material adverse changes by email to your registered address and by posting on this page with a revised "Last updated" date. Material changes take effect no earlier than 30 days after notice, apply prospectively only, and do not affect disputes that have already arisen. If you do not agree to a material change, you may cancel before the effective date, and the prior Terms will govern until the end of your then-current paid subscription period, unless an immediate change is required by law or for security reasons. Where applicable law requires your affirmative consent, the change will not bind you unless you accept it.
